Terms and Conditions

1.0 Definitions:

  1. Agreement: means this document and the associated terms and conditions.
  2. Card: means credit and debit cards issued by Visa and MasterCards scheme issuers.
  3. Payee: means those individuals or businesses that provide goods and services (Travel Products) to You within the travel industry and have an agreement with Jet Seeker, either directly or via a Third Party Provider to process their searches, bookings and payments on their behalf.
  4. Payer: means those individuals or businesses (You) that have an agreement with Jet Seeker to use their services to pay a Payee for their goods or services.
  5. Payment Request: Your authorisation for Us to debit Your nominated card.
  6. Third-Party Provider: means a business, typically supplying Travel Products within the travel industry, either directly or on behalf of a Payee.
  7. Travel Product: means those goods or services supplied by a Payee or Third Party Provider to You the Payer via an agreement they have with Jet Seeker to use their travel search, booking and payments collections services.
  8. Travel Service: means the ability for You to search, book and pay for travel related products to a Payee via technology and payments processing services supplied by Jet Seeker.
  9. Travel Service Fees and Charges: means the fees charged to use the Travel Service provided by Jet Seeker. The Travel Service Fee and Charges is not the Travel Product related fees and charges of the Payee.
  10. You/Your: means the individual or company identified in this Agreement. You must be at least eighteen (18) years old to use the Service.
  11. Us/We/Our: means Jet Seeker Pty Ltd (ABN 486 623 444 842) otherwise known as Jet Seeker.

2.0 Contractual relationship

This Agreement sets out the Terms and Conditions on which We process Your search, booking and payments on behalf of the Payee or Third Party Provider. By accepting this Agreement You agree to accept the Terms and Conditions associated with the Travel Services supplied by Jet Seeker.

You acknowledge this Travel Service is provided by Jet Seeker and it is optional. The Travel Service is not intended to restrict You from making searches, booking and payments to Payees or Third Party Providers via other methods.

You acknowledge that this Travel Service allows You to only pay to those Payees or Third Party Providers that have an agreement with Jet Seeker.

Jet Seeker does not endorse, recommend or guarantee any particular Travel Product supplied by a Payee or Third Party Provider.

3.0 Variations and amendments to the Terms and Conditions

We may vary these Terms and Conditions inclusive of the Travel Service Fee. Any amendment will take effect as soon as posted on the Website (www.jetseeker.com.au).

4.0 Travel Services

Jet Seeker supplies the following Travel Services:

4.1 Aggregation of travel-related goods and services (Travel Products). Aggregation includes the following:
  1. Travel-related goods and services offered on the Jet Seeker website from Payees or Third Party Providers.
  2. Flight search and bookings, which includes:
    1. Access to a flight booking website which provides the facility for You to search for and make a flight booking with an airline.
    2. Payment processing, documentation and ticketing services associated with Your booking.
    3. Access to customer services which includes access to staff either online, by email or by phone to confirm Your booking, make any changes to Your booking or otherwise seek general assistance with Your booking.
4.2 Information on the website

(a) Some of the material accessible through the website is provided by Payees or Third Party Providers. This material does not form part of the Travel Services and Jet Seeker is not responsible for this material. Jet Seeker does not warrant, and disclaims any liability for the accuracy or completeness of the information provided by Payees or Third Party Providers in relation to their specific Travel Products.

(b) Information provided through the website is provided in good faith, and is subject to amendment at any time without notice.

(c) You should make Your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the website.

(d) You should carefully read and ensure You understand all the Travel Products specific terms and conditions before finalising Your travel booking.

(e) The website does not include every Travel Product available in the market.

(f) Jet Seeker reserves the right to modify prices and products of any Travel Products it displays on its website for its own commercial or marketing reasons. Jet Seeker makes no representation that its prices or products are identical to the prices or products displayed on other Travel related sites that may exist from time to time.

4.3 Website site software

When You access a Jet Seeker website You are accessing and using software which is owned by or licensed from Jet Seeker Pty Ltd. Each time You access the website You are deemed to be a “Visitor”.

For each Visitor, Jet Seeker, grants a personal non-exclusive license to use the software associated with the Jet Seeker website for the duration of the visit and for the sole purpose of making Travel Product searches, bookings and payments (“License”).

This License does not permit You to make a visit for the purpose of “carrying on a business as a travel agent” within the meaning of Australian State and Territory legislation regulating travel agents, unless You are a licensed travel agent under that legislation. Any other use, commercial or otherwise, of the software or information on the site without the express written permission of Jet Seeker is strictly prohibited, including any reproduction, data mining, automated querying or similar data extraction processing.

You acknowledge that copyright exists in all software provided in association with the visit. Where copying or transmission is expressly permitted, You must not change or delete any author attribution or copyright notice. You must not use the software associated with the Travel Service except in accordance with the License.

4.4 Customer Service

When You make a flight booking through the Jet Seeker website the Service Fee charged and paid as part of the booking provides You with access to Our customer service team.

The customer service provided includes access to staff either online, by email or by phone to confirm Your booking, make any changes to Your booking or otherwise seek assistance with Your booking.

The customer service provided is supplied during business hours.

5.0 Travel Products

5.1 Product Terms and Conditions

In addition to these Terms and Conditions, Payees or Third-Party Providers may impose their own terms and conditions in relation to their Travel Products. These terms and conditions must be accepted as a condition of their booking. You should carefully read and ensure You fully understand the terms and conditions specific to any applicable Travel Products before completing Your booking.

5.2 Flights

Jet Seeker acts as an agent on behalf of the applicable Payee’s or Third-Party Provider(s) in providing access to flight bookings. Jet Seeker provides searching, booking and payment collection services for these Payees or Third-Parties.

The fulfillment of the flight or flights is provided by the applicable Payee or Third Party Provider selected at the time of finalising the booking. For Your air travel, You are bound by the specific terms and conditions of the selected flight and associated airline(s), Payees or Third Parties.

Jet Seeker is not responsible for subsequent changes to airline scheduled departure times, departure dates or flight cancellations. All additional costs, charges or fees associated directly or indirectly with any changes to a flight is a matter between You and Your selected airline, Payee or Third-Party Provider.

6.0 Your obligations to Us.

6.1 Your obligations:

(a) You must only access and use the Travel Services:

(i) to make searches, enquiries about and bookings for Travel Products on the Website (permitted purpose);

(ii) in accordance with these terms;

• have sufficient value on Your Card Account to meet all charges for Travel Products You book through the Booking Facility;

• keep secure any means of identification that Jet Seeker provides to You in relation to Your specific booking;

• comply with all requirements for the Travel Product You’ve booked, including any Product Terms (where applicable); and

• ensure that You have the necessary identification and visa documentation to travel.

(b) You must not:

(i) access or use the Services;

• for any activities which breach any laws, infringe any Payee’s, Third-Party Provider’s or third parties rights, or breach any standards, content requirements or codes promulgated by any relevant authority;

• in any way which interferes with other users or defames, harasses or menaces anyone;

• for any purpose (commercial or otherwise) other than the permitted purpose without the express written permission of Jet Seeker, including any reproduction, data mining, automated querying or similar data extraction processing;

(ii) reverse, cancel or chargeback a valid payment without Jet Seeker’s prior written consent;

(iii) resell the Travel Services, Travel Products or any other products and services accessed by means of the Travel Services; or

(iv) permit any other person to use Your identification details to access the Travel Services, or grant a third-party the right to access and use the Travel Services.

(c) You are solely responsible for:

(i) assessing the suitability of any Travel Products for Your needs; and

(ii) all matters relating to complying with the laws and regulations of all immigration authorities of the countries You travel to and from.

6.2 Intellectual property

(a) All intellectual property rights in the website and the booking facility are owned by Jet Seeker and/or its licensors (as applicable). The only rights You have to this intellectual property are the limited rights to use and access the website and the booking facility for the permitted purpose.

(b) You must not:

(i) disassemble, decompile, reverse engineer the whole or any part of the software accessed by means of the Travel Services; or

(ii) modify, copy, transmit, display, perform, publish, license or create derivative works from any information or software accessed by means of the Travel Services.

6.3 Your information

(a) Jet Seeker may use and disclose any personal information collected by Jet Seeker about You in accordance with Jet Seeker’s privacy policy, available at www.jetseeker.com.au/content/privacy-policy.

Jet Seeker may also provide such personal information to its related entities and to airlines, Payees or Third-Party Providers as is required to complete Your booking. You accept that the recipients of this disclosure may not have in place privacy policies equivalent to Jet Seeker’s.

(b) Jet Seeker may use information about You for marketing, internal planning or product development purposes in order to improve the quality of Jet Seeker’s services, and may disclose some of Your information at an aggregate level for marketing purposes provided that You cannot be personally identified from this aggregated data.

(c) You grant Jet Seeker Your ongoing consent to use Your information to promote and market Jet Seeker’s products and services and make other offers to You (including by making telemarketing calls to You, and sending You electronic messages including via email and SMS) and will be automatically added to Jet Seeker’s email newsletter for product and promotional updates. You acknowledge that this consent continues indefinitely until such time as You expressly withdraw it. If You do not wish Jet Seeker to contact You or You would like Jet Seeker to stop promoting and marketing products, services and other offers to You, please either unsubscribe from those updates or contact Jet Seeker at any time by submitting a request through Jet Seeker’s feedback form on www.jetseeker.com.au.

6.4 Commission

You acknowledge and agree that Jet Seeker may receive a commission or an affiliate fee or a marketing fee from transactions entered into by You using the Travel Services.

7. Travel requirements

7.1 Passports

(a) All departing passengers require a valid passport for international travel. This means the passport must be valid for a set minimum period beyond Your travel dates (the required minimum period depends on the country You visit).

(b) Please ensure You have a valid Passport well in advance of travel as either the airline staff or immigration authorities will not allow You to pass through customs and board Your flight without this documentation.

7.2 Visas

(a) A visa provides You with the authority as a non-citizen to travel to another country. Some countries will not allow You to enter without a visa, or in some cases, without proof of a return or onward electronic or paper ticket.

(b) Please ensure You have a valid visa (as applicable) for all the countries You are travelling to which require a visa well in advance of travel as either the airline staff or immigration authorities will not allow You to pass through customs and board Your flight without this documentation.

(c) Visas are obtained from the countries issuing authority, usually an embassy. Visa requirements vary by both country You are travelling to and the current citizenship You hold so please ensure You check well in advance of Your travel dates to allow sufficient processing time as required by the embassy. If You have booked a one-way ticket please ensure You have checked with the Consulate of the country You are travelling to in order to ensure that You comply with their laws and regulations.

7.3 Infection Diseases and Pandemics including COVID 19

(a) You should familiarise yourself with airline and government requirements around passenger safety, including the requirement for face masks and the need to produce evidence meeting airline and border control requirements in relation to COVID-19 or any other infectious disease or pandemic both for transit and final destination passengers. This information is subject to change without notice. It is recommend to stay up to date with relevant airline and government policies for your transit and final destination at each of;

  • the time of booking,
  • as you approach your travel date, and
  • immediately before travel.

(b) You acknowledge that you are choosing to travel at a time where you may be exposed to the Coronavirus and or other infectious or pandemic diseases. It is your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks. You acknowledge that your decision to travel is made based on your own consideration of this information, and you acknowledge and agree that you are aware of, and assume responsibility for, the risks associated with traveling at this time. To the fullest extent permitted by law, we accept no liability in relation to these additional risks and or costs You may incur.

7.4 General travel information

(a) Jet Seeker recommends before travelling You check the Government website relating to the states or countries You are travelling to for any applicable travel advisories relevant to those states or countries. See here for additional information from Smart Traveller on country specific travel advisory information.

8. Payments and Refunds

8.1 Payment

(a) Jet Seeker supports the ability for you to search, book and pay for certain Travel Products by Card online.

(b) Once a booking is made it must be paid in full in order to purchase the Travel Product(s).

(c) By clicking “Proceed to Payment”, You accept:

(i) the fees and charges payable to Jet Seeker set out in the payment confirmation notification and payment summary supplied with the booking; and

(ii) the Payee’s or Third-Party Provider’s offer to sell the Travel Products to You for the price set out in Your shopping cart are subject to these Travel Service terms and any applicable Travel Product terms.

(iii) that Jet Seeker may need to supply Your billing, payment and identification information (including personal information) to those Payee’s or Third-Party providers who will supply the Travel Products and accept that the recipients of this disclosure may not have in place privacy policies equivalent to Jet Seeker’s.

(iv) that Jet Seeker will automatically securely store Your Card details for future use if You:

• qualify for a refund

• would like to purchase additional services and approve the use of these details again

(d) Your booking is not confirmed until full payment is received by Jet Seeker and confirmation is provided to You by Jet Seeker, the Payee or the Third-Party Provider with a confirmation or booking number for each element of the Travel Product(s) booked.

8.2 Transaction Verification

(a) You:

(i) authorise Jet Seeker’s to:

• charge all fees and costs associated with Your booking to the Card designated by You;

• securely disclose Your Card details to, and obtain information from, any financial institution or card issuer to verify the Card and identification details that You may provide;

• take steps to confirm that there is sufficient value on Your Card account to meet likely charges;

(ii) authorise Your card issuer or financial institution to verify that the Card and identification details You have provided to Jet Seeker are accurate; and

(iii) consent to Jet Seeker supplying Your billing, payment and identification information (including personal information) to those Payee’s or Third-Party Providers who will supply the Travel Products in Your booking to You.

(b) Before Jet Seeker proceeds to process any travel booking on Your behalf or issues Your travel documentation, various checks are taking place to validate the integrity of the Card information and in certain circumstances the cardholder will be required to submit verification documentation to substantiate identity. This process is intended to reduce the potential risk for fraud and disruption to passengers upon check in.

(c) If Your Card payment is not approved, Jet Seeker may attempt to contact You. Where Jet Seeker cannot contact You and the ticket issuance period lapses (thereby making the booking invalid), Jet Seeker will have no choice but to cancel the booked arrangements. Under these circumstances Jet Seeker accepts no responsibility for any re-booking costs.

(d) Jet Seeker reserves the right, at its absolute discretion, to decline or accept bookings. Any automatic booking confirmations for such bookings are conditional contingent on Jet Seeker’s view of any financial risks, potential ticket despatch delays, or other regulations that may apply.

(e) If payment to Jet Seeker is not received for Your confirmed booking for any reason, You agree to pay Jet Seeker all amounts due on demand.

8.3 Refunds

(a) Refunds may be payable to You from a Payee or Third Party Provider You may have booked with.

(b) Your right to a refund on a booking is governed by the terms and conditions of the Travel Product You purchased and is determined by the applicable Payee or Third-Party Provider. Note, many Travel Products are non-refundable and or may incur change and cancellation fees. Any cancellation or change fees will be typically automatically deducted from any due refund.

(c) Jet Seeker shall only be liable to provide a refund to You to the extent that it actually receives a refund from the relevant Payee or Third-Party Provider. Where refunds are due to You from a Payee or Third-Party Provider, Jet Seeker will provide reasonable assistance to You in claiming such funds from that Payee or Third-Party Provider. In that situation, Jet Seeker is authorised (but not obliged) to seek such refunds from the Payee or Third-Party Provider directly and on its own behalf.

(d) Where a refund is applicable, the turnaround time from the date of Your request for refund to the date You are provided with Your refund may take up to 12 weeks. This is beyond the control of Jet Seeker as it may be a term or condition of the Payee or Third-Party Provider

(e) Travel Service Fees charged by jet Seeker are non-refundable irrespective of if the booking was successful or later canceled, changed or refunded.

9. Changes and cancellations

9.1 Jet Seeker is reliant on the availability of Travel Products from Payees or Third-Party Providers. Jet Seeker reserves the right to amend Your booking at any time, in consultation with You, if:

(a) An error is made by the Payee or Third-Party Provider in relation to a Travel Product; or

(b) In circumstances beyond Jet Seeker’s reasonable control, the Payee or Third-Party Provider advises that it is unable to provide the Travel Product at the price advertised.

In such circumstances additional charges may have to be paid by You for the Travel Products and/or Your travel itinerary may need to be changed.

9.2 If You wish to change your booking with Jet Seeker, Jet Seeker may charge You a change Fee. This fee will be detailed to you by the Jet Seeker support team member before any change or cancellation is made.
9.3 If You cancel any Travel Product You may incur cancellation charges from the Payee or Third-Party Providers supplying the cancelled Travel Product and You agree to indemnify Jet Seeker (and any related parties) for any fees or charges changed by them or incurred by You in relation to Your cancellation. As detailed in 8.3 (b) any cancellation fees will be deducted from any refund that may be due to you.

10. Unavoidable or Extraordinary Circumstances

In the event of unavoidable or extraordinary circumstances, a Payee or Third Party Provider may materially modify or cancel your booking.

In these Terms and Conditions “Unavoidable or Extraordinary Circumstances” means any cause outside a Payee or Third-Party Providers reasonable control which could not have been prevented or avoided even if all reasonable measures had been taken by the Payee or Third-Party Provider (including, but not limited to);

  • War;
  • Threat of war;
  • Civil disturbances;
  • Industrial dispute;
  • Terrorist activity and related consequences;
  • Plague;
  • Epidemic;
  • Pandemic;
  • Infectious disease outbreak or any other public health crisis including changes to quarantine or employee restrictions);
  • Natural or other disaster (such as volcanic ash or hurricanes or similar events);
  • Nuclear incident;
  • Fire or bushfires;
  • Adverse weather conditions (actual or threatened, including snow and fog);
  • Closed or congested airports/ports or other transport centres;
  • Unforeseen alterations to transport schedules (includes air, sea, or land transport);
  • Transportation disruptions or cancellations;
  • Travel restrictions;
  • Changes to travel advisories;
  • Travel restrictions;
  • Changes to travel advisories;
  • Changes to immigration, labour or free movement;
  • Laws resulting from BREXIT;
  • Changes to applicable laws or government mandates (including evacuation orders and border closures); or
  • Any similar event.

A material modification is one that has a serious impact on your booking and would cause substantial inconvenience to You (including a change of departure date, departure point or airport, or change of departure time of more than twelve hours).

Where an Unavoidable or Extraordinary Circumstance generates a material modification you acknowledge Jet Seeker is not responsible for subsequent changes to airline scheduled departure times, departure dates or flight cancellations. All additional costs, charges or fees associated directly or indirectly with any changes to a flight is a matter between You and Your selected airline, Payee or Third-Party Provider.

11. Monies Not Held On Trust

You agree and acknowledge that such monies paid by You to Us will not be held by Us on trust for and on behalf of You and We may hold such monies in any bank account as we see fit, including with our own and/or other customer monies.

All monies paid by you to Us will be the property of JetSeeker as the “Merchant of Record” and will be a debt due and payable to the Payee or Third-Party Provider in accordance with the payment terms we have agreed with them. Payment will generally be made to the Payee or Third-Party Provider before the services to which the money relates are provided, however in some cases, payment will be made once the services to which the money relates have been provided.

In respect of monies paid for flights for an IATA airline, such monies might be held on trust for that IATA airline in accordance with the payment terms we have agreed with that IATA airline. In the event We are still holding the monies, We can only provide you with a refund once We are authorised by the Payee or Third-Party Provider to process Your refund, subject to that Payees or Third-Party Providers change or cancellation policy.

12. Travel Service Fees and Charges

The following Travel Service Fees and Charges may apply to Your Booking:

12.1 Card Booking Fee

Jet Seeker may charge You a non-refundable card booking fee in relation to processing Your booking and accepting Your preferred payment type.

Card booking fees are charged by Jet Seeker in its own capacity (as a merchant), and not as an agent for any other Payee or Third Party Provider.   Card booking fees cover a range of payment processing costs in relation to Your booking, including the reasonable costs of accepting and processing the selected payment type. Card booking fees will be shown in the price of Your booking on the checkout page after a payment method has been selected and You will be given the option to accept or decline the booking when this fee is displayed.  

12.2 Servicing Fee

Jet Seeker may charge You a non-refundable servicing fee in relation to Your booking.  This fee will be included in the cost of the booking.

The servicing fee covers a range of costs, services, fees and charges that Jet Seeker incurs in relation to providing You with a Customer Service in relation to Your booking and includes GST. The servicing fee covers the cost of providing customers with general assistance when a Payee or Third Party Provider initiates a scheduled change.  It does not cover the cost of changing, canceling, reissuing or refunding a ticket.  The costs incurred by You due to the Payee or Third Party Provider of a schedule change is determined by the terms and conditions of the Travel Service and or Travel Product and accepted by You as part of Your booking.

The servicing fee also allows Jet Seeker to provide customers access to support channels including telephone, live chat, email and frequently asked questions.

12.3 Additional fees and charges

Jet Seeker reserves the right to charge change or cancellation fees depending on circumstances and Payee or Third-Party Product Service or Travel Products terms. Any charges will be notified to You before proceeding.  Additional fees and charges may apply in the following circumstances:

(a)Booking changes including reissue, revalidation, itinerary change and upgrade

(b)Additional requests for quotes, ticketing or travel options

(c)Ticket cancellation and refunds.  Cancellations and refunds related to partial or complete cancellation of a Payee or Third Party booking.   In many cases bookings are not able to be changed once booked and depending on the Travel Product may be completely non-refundable.  There are different and varied Travel Product rules that apply to each booking, in addition to Jet Seekers fees Payees and Third Parties Provider may charge a cancellation penalty which is beyond the control of Jet Seeker. Cancellation fees may apply to each individual Travel Product issued.

(d)Name correction.  Names provided during the booking process must exactly match names as they appear on each traveller’s passport, without exception.  Some Payees or Third Party Provider, especially airlines, do not allow name changes at all once a booking has been made. Names provided in your reservation match your passport details as name change policies vary between Payee/Third Party Provider.  The process of correcting the name provided in the booking is manual and involves multiple time consuming steps before being processed by Jet Seeker. Additional Payee or Third Party change fees may apply to each individual Travel Product issued.

(e)Schedule changes.  In the event of a change or cancellation to a ticketed booking which requires a re-issue, re-validate and refund of the Travel Product due to a Payee or Third Party scheduled change.  Change fees may apply to each individual Travel Product issued.

13. Pricing

13.1 Pricing

(a) All pricing is reflected in Australian Dollars (AUD) unless otherwise specifically denoted on the screen.

(b) Jet Seeker makes no representation that the prices displayed on the Web Site are identical to prices on individual airline, Payee or Third-Party Provider sites that may exist from time to time.

(c) Jet Seeker reserves the right for marketing and commercial reasons to modify prices.

(d) The Payment Convenience and Servicing Fees and Charges for bookings are non-refundable.

(e) Prices shown are always based upon the Travel Product purchased and its associated terms and conditions. If additional services, changes or cancellations are required these may incur additional fees or charges. Note in some cases the bookings prices may not include local taxes, fees or charges.

13.2 Currency variations

For some bookings Jet Seekers results page may indicate that some of the Travel Products pricing has been converted to AUD at the exchange rate on the day of booking. Variations to Your final price may occur due to currency fluctuations. Please note, where any pricing has been converted from a foreign currency to AUD Your Card company may charge a conversion fee. The conversion fee will be typically displayed on your Card statement..

13.3 GST for non-residents booking domestic flights in Australia

GST is still applicable in circumstances where Your domestic ticket is booked and ticketed separately to the international portion of Your ticket or where it is subsequently separately booked and ticketed.

14. Liability

Jet Seeker makes no representations, warranties or guarantees in relation to the Travel Products, Packages or the availability, continuity, reliability, accuracy, currency or security of the Travel Services. All warranties and other terms which are not expressly included in these terms and conditions are excluded to the maximum extent permitted by law.

Except as expressly provided to the contrary in this Agreement, all terms, conditions, warranties, undertakings, inducements or representations whether expressed, implied, statutory or otherwise, relating in any way to the Travel Services or to this Agreement are excluded.

Without limiting the generality of the preceding sentence, we shall not be under any liability to You in respect of any loss or damage (including consequential loss or damage) however caused, which may be suffered or incurred or which may arise directly or indirectly in respect of the failure or omission of us to comply with its obligations under this Agreement.

You warrant that You have not relied on any term, condition, warranty, undertaking, inducement or representation made by or on behalf of Us which has not been stated expressly in this Agreement or upon any descriptions or illustrations or specifications contained in any document including any catalogues or publicity material produced by Us.

If any warranties are implied by law that cannot be excluded, then to the maximum extent permitted by law our liability for breach of such warranties is limited to, at Our option:

(a) in the case of Travel Products:

(i) the replacement of the Travel Products or the supply of equivalent Travel Products;

(ii) the payment of the cost of replacing the Travel Products or acquiring equivalent Travel Products;

(b) in the case of Travel Services:

(i) the supply of the Travel Services again;

(ii) the payment of the cost of having the Travel Services supplied again.

14. Indemnification

You agree to defend and indemnify Jet Seeker, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

(a) Your breach of this Agreement or the documents referenced herein;

(b) Your breach of any law or the rights of a Payee or Third-Party Provider; or

(c) Your use of this Website.

15. General

15.1 Assignment

You must not novate or assign any of Your rights under these terms to a Third-Party Provider.

15.2 Governing Law

These terms are governed by the laws in force in Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria and courts of appeal from them for determining any dispute concerning these terms.

15.3 Entire Agreement

These terms and conditions constitute the entire agreement between the parties in relation to their subject matter.
